Rules & Regulations

The LOTTO MAX “Up Close” Live contest (the “Contest”) is held by the Ontario Lottery and Gaming Corporation (“OLG”) and is organized and administered by Universal Music Canada Inc. (“UMC”) and its subsidiaries (the “Contest Organizer”).

The Contest commences on August 22, 2017 and ends on October 5, 2017 at 11:59:59 pm. For the purposes of these Official Rules and Regulations all times and dates refer to Eastern Time (“ET”).

Participation in the Contest constitutes full and unconditional agreement and acceptance of these Official Rules and Regulations (the “Contest Rules”), which are binding on all matters relating to the Contest.

  1.      Eligibility:   No Purchase Necessary.  The Contest begins on Tuesday, August 22, 2017 and closes at 11:59:59 p.m. ET on October 5, 2017 (the “Contest Closing Date”) (collectively, the “Contest Period”).

This Contest is open only to legal residents of Ontario who are 18 years of age or older. Notwithstanding the foregoing, the Contest is not open to: employees (and their immediate families and those with whom they are domiciled) of UMC, OLG, OLG’s authorized retailers (including sole proprietorships and corporation partnerships), the Alcohol and Gaming Commission of Ontario, and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies. Immediate family includes the husband, wife, son, daughter, brother, sister, mother, or father of an individual.

  1. PRIZES AND CHANCES OF WINNING:   

2.1    There are five categories of prizes available to be won: (a) twenty-five (25) Grand Prizes, as outlined in Rule 5 below (each a “Grand Prize” and collective the “Grand Prizes”); (b) eight (8) secondary prizes, as outlined in Rule 5 below (each a “Secondary Prize” and collectively the “Secondary Prizes”); and (c) three-hundred-and-fifty (350) tertiary prizes, as outlined in Rule 5 below (each a “Tertiary Prize” and collectively the “Tertiary Prizes”)

2.2    The odds of winning a Grand Prize, Secondary Prize or Tertiary Prize depend on the total number of all entries (regardless of the method of entry) received during the Contest Period.

2.3    Entrants are limited to winning one (1) Grand Prize, one (1) Secondary Prize or one (1) Tertiary Prize

  1.      How To Enter:

Entrants will be prompted to create a user profile (“User Profile”) by registering their Facebook, Instagram or Twitter profile. when first accessing the Contest entry page. For each social account entrants will receive one (1) entry into the contest for a maximum total of three (3) entries. The User Profile will be used for the submission of additional bonus entries as highlighted below in Rule 4.

First Time Online Entry:  Anytime during the Contest Period, visit www.lottomaxupclose.ca ,

or www.lottomaxupclose.com and follow the Contest link to the LOTTO MAX “UP CLOSE” contest and fully complete and submit the online entry form, including registration of your Facebook, Twitter and/ or Instagram. 

  1.      How To Earn BONUS Entries (No Purchase Necessary):
  1. Share the contest with family and friends on social media. Anytime during the Contest Period, visit www.lottomaxupclose.ca or www.lottomaxupclose.com and follow the Contest link to the LOTTO MAX “UP CLOSE” contest and login using your username and password. Submit the online entry by sharing a unique contest URL provided to each User Profile with friends (“Friend Referral”). One (1) Friend Referral is equal to one contest entry, through this method of entry.  The bonus entry is only valid if your friend referral registers for the contest. You can refer an unlimited amount of friends.

 

  1. LOTTO MAX UP CLOSE CHALLENGE: Register with your Twitter, Instagram and/or Facebook username and password, and respond to the LOTTO MAX “UP CLOSE” Challenge. Entrant may respond to the LOTTO MAX “UP CLOSE” Challenge by submitting an online photograph or video of the participant and an Up Close Concert Friend. “Entrant” means the eligible person who submits a photo or video. Submit the online entry by engaging with the challenge from your Twitter, Instagram or Facebook social media account, and meeting the following requirements:
    1. Post must include the hashtag #LottoMaxUpClose
    2. Posts on Facebook and Twitter must tag @lottomax
    3. Post must include a photo or video of you and your Up Close Concert Friend.  Up Close Concert Friend is defined as a person 18 years of age or older that you would like to take to the LOTTO MAX Up Close concert.  Photos or videos must only include you and your friend and have been granted permission from the friend to post their photo or video.
    4. Photos and videos must not depict you or anyone in any state of undress, or disorderly conduct. Submissions with any sort of nudity or indecent activity will be automatically disqualified and entry removed
    5. Submissions which involve anything illegal, potentially or actually dangerous or harmful or containing any element off physical risk will be disqualified from the contest and have no chance of winning.

Each photo or video submission must have obtained the necessary consent of the friend or 3rd party that appear in photo or video and be used for the purposes of this contest. Any photos or videos that do not have consent have no chance of winning.

There will be no compensation, financial or otherwise for any of the photos or videos that are submitted as entries for the Contest.

    1. Each daily entry must be a unique photo or video and not submitted in whole or in part previously
    2. Photos or videos must be taken during the promotion period.

All Photos and videos will be judged by a panel of judges appointed by the Sponsors in their sole and absolute discretion (“Judges”). The Judges will judge each eligible Photo and Video submitted and received in accordance with these Rules on the basis criteria such as creativity, originality, relevance to the challenge theme, however the selection as an eligible winner depend on the number and calibre of eligible Entries submitted and received in accordance with these Rules.

One (1) engagement or reply to the LOTTO MAX “UP CLOSE” challenge is equal to one contest entry. Entrants will receive one (1) entry per post on Facebook, one (1) entry per post on Instagram, and one (1) entry for per post on Twitter. There is no limit to the amount of entries.  Entries will be moderated and judged based on the entry meeting the challenge criteria and Rules.

    1. All valid entries will be entered to win one (1) of six (6) pairs of VIP tickets to the LOTTO MAX UP CLOSE concert on October 14, 2017 plus one (1) $100 LOTTO MAX Free Play Voucher.
  1. LOTTO MAX ENCORE: Create your dream ENCORE setlist for Broken Social Scene and share it on Facebook, Instagram or Twitter from the Lotto Max Up Close contest site and meeting the following requirements:
    1. Post must include the hashtag #LottoMaxUpClose
    2. Posts on Facebook and Twitter must tag @lottomax
    3. Post must include your dream Broken Social Scene setlist.
    4. Entries will be judged on the following criteria: Adherence/Appropriateness to the challenge theme; and there must be at least two (2) songs and maximum of 10 songs total in the setlist.
    5. Songs chosen must only be from Broken Social Scene’s catalog of music/songs.
    6. All valid entries will be entered to win one (1) of twenty-five (25) pairs of VIP tickets to the LOTTO MAX UP CLOSE concert on October 14, 2017 plus one (1) $100 LOTTO MAX Free Play Voucher.
    7. One (1) engagement or reply to the LOTTO MAX “UP CLOSE” challenge is equal to one contest entry. Entrants will receive one (1) entry per post on Facebook, one (1) entry per post on Instagram, and one (1) entry for per post on Twitter. Entrants will earn one (1) entry per day per social media account for a maximum total of three (3) entries per day. Entries will be moderated and judged based on the entry meeting the challenge criteria and Rules.
    8. The setlist entries will not be the ENCORE setlist that the band performs on October 14, 2017

In order to be eligible to participate in the Contest, entries must be received during the Contest Period. Only entries received in accordance with these Contest Rules will be accepted. No other methods of entry will be accepted.

Any personal information collected by OLG and/or the Contest Organizer is collected pursuant to the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to be used for the following principal purposes: to conduct and administer the contest by OLG and/or the Contest Organizer, including but not limited to the awarding of the Grand Prize or Secondary Prize, and to comply with legal requirements. Where you have provided your consent, OLG may then provide you with the information or services you have opted in to receive. In addition, without limiting the generality of the foregoing, if you are confirmed as a prize winner, you consent that your photo, name, and residence (town or city only) may be posted, published, or announced on by OLG on the OLG website and/or other media for up to 12 months after being confirmed as a winner. Except where prohibited, participation in the Contest constitutes consent to the use of a contestant’s or winner’s or Up Close Concert Friend’s name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, worldwide, without further payment, consideration, notice or approval.

All entries will become the property of the Contest Organizer and OLG and will not be returned. Entries which are incomplete or fraudulent are null and void. Multiple entries using the same email account or using any device to play multiple times or as multiple contestants will result in disqualification.  All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.  In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the Contest at the actual time of registration will be deemed to be the participant and must comply with these Contest Rules; the unauthorized subscriber(s) will be disqualified. An authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization, which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide the Contest Organizer and/or OLG with government issued ID and proof that the potential winner is the authorized account holder of the e-mail address associated with the potential winning entry. By entering the Contest, you agree to be bound by the decisions of the Contest Organizer and/or OLG, which are final with respect to all matters relating to the Contest. The Contest Organizer and OLG accept no responsibility for entries which are lost, misdirected or delayed for any reason.  Nor is any responsibility assumed for incorrect or inaccurate capture of entry information, including (but not limited to), malfunction, human error, lost/delayed/garbled Internet/e-mail transmission, omission, interruption, deletion, defect, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof.

  1.      Prizes:   The following prizes are available to be won:

Grand Prizes

There are a total of twenty-five (25) Grand Prizes available to won in this Contest. Each Grand Prize consists of:

  •       Two (2) GA floor tickets to see Broken Social Scene live at the Phoenix Concert Theatre – 410 Sherbourne Street. Toronto, Ontario on October 14, 2017 at 7:00 pm; and
  •       One meet & greet with Broken Social Scene for the winner & a guest at The Phoenix Concert Theatre on October 14, 2017 (subject to artist availability and to be determined by UMC and OLG in their sole discretion). Details to be confirmed by UMC.
  •       One (1) $100.00 CDN LOTTO MAX Free Play voucher

Each prize winner and their guest must be 18 years of age or older. In all cases, Contest Organizer and / or OLG reserve the right to request proof from the Grand Prize winner and guests of their respective identity, age and residency, as applicable. Approximate retail value of each Grand Prize is five-hundred dollars ($500.00 CDN)

Secondary Prizes

There are a total of six (6) Secondary Prizes available to be won in this Contest.

Each Secondary Prize consists of:

  •       Two (2) VIP Access passes for the winner & a guest at The Phoenix Concert Theatre on October 14, 2017 . Passes include designated balcony seating and special VIP room inside the venue. Details to be confirmed by UMC.
  •       One (1) $100.00 CDN LOTTO MAX Free Play voucher

Each Prize winner and guest must be 18 years of age or older. In all cases, the Contest Organizer and/or OLG reserve the right to request proof from the Secondary Prize winner and guests of their respective identity, age and residency, as applicable. Approximate retail value of each Secondary Prize is three hundred dollars ($300.00 CDN)

Tertiary Prizes

There are a total of three-hundred-and-fifty (350) Tertiary Prizes available to be won in this Contest.

Each Tertiary Prize consists of:

  •       Two (2) of tickets to see Broken Social Scene live at The Phoenix Concert Theatre – 410 Sherbourne Street., Toronto, Ontario on October 14, 2017 at 7:00 pm
  •       One (1) $100.00 CDN LOTTO MAX Free Play voucher

Each Prize winner and guest must be 18 years of age or older. In all cases, the Contest Organizer and/or OLG reserve the right to request proof from the Tertiary Prize winner and guests of their respective identity, age and residency, as applicable. Approximate retail value of each Tertiary Prize is three hundred dollars ($300.00 CDN)

All incidental costs and expenses not specifically identified as being included in the Tertiary, Secondary or Grand Prizes including (without limitation) transportation from winner’s residence to and from event location (The Phoenix Concert Theatre), meals, beverages, alcoholic beverages, insurance, entertainment and items of a personal nature, or any other expenses not specifically mentioned shall be the sole responsibility of each winner and their guest. Winner may bring one (1) guest that must be 18 years of age or older at time of event and that same guest must complete all prizing elements with winner. Transportation will not be provided for the winner or guest to or from the Phoenix Concert Theatre.

Grand Prize, Secondary Prize and Tertiary Prize winners and guests must follow all directions of the Contest Organizer and/or OLG. Failure to do so may result in termination of their participation, or continued participation, in the Grand Prize, Secondary Prize or Tertiary Prize, as applicable.

  1.      Draw/Winner Selection:

Grand Prize Draws:  Week one through five of the contest period four (4) entrants will be selected by a panel of judges from Universal Music Canada and Lotto Max. Five (5) entrants will be selected on week six of the contest period.  Entries will be judged in accordance with the criteria and Rules  set forth in section 4.3 (a to f)

A total of twenty-five (25) grand prize winners will be selected during the contest period at SHED Creative Agency, 110 Spadina Ave. Toronto Ontario, M5V 2K4 . Chances of winning a Grand Prize depends on the number of eligible entries received in the LOTTO MAX ENCORE Challenge by the Contest Closing Date.

Selection for the Grand Prizes will take place as follows:

  • August 29th, 2017 – four (4) selected winners from the entries will be chosen
  • September 5th, 2017 – four (4) selected winners from the entries will be chosen
  • September 12th, 2017 – four (4) selected winners from the entries will be chosen
  • September 19th, 2017 – four (4) selected winners from the entries will be chosen
  • September 26th, 2017 – four (4) selected winners from the entries will be chosen
  • October 4th, 2017 – five (5) selected winners from the entries will be chosen

Eligible Grand Prize winners will be notified by either telephone or email between August 29th, 2017 and October 4th, 2017 at such telephone number/email address as provided on the Contest entry form.

Secondary Prize Draw:  A total of six (6) secondary prize winners will be selected during the contest period at SHED Creative Agency, 110 Spadina Ave. Toronto Ontario, M5V 2K4 between August 29th, 2017 and October 4th, 2017.   • August 29th, 2017 – one (1) selected winner from the entries will be chosen
  • September 5th, 2017 – one (1) selected winner from the entries will be chosen
  • September 12th, 2017 – one (1) selected winner from the entries will be chosen
  • September 19th, 2017 – one (1) selected winner from the entries will be chosen
  • September 26th, 2017 – one (1) selected winner from the entries will be chosen
  • October 4th, 2017 – one (1) selected winner from the entries will be chosen

Eligible Secondary Prize winners will be notified by either telephone or email at such telephone number/email address as provided on the Contest entry form.

Tertiary Prize Draw:  A total of three-hundred-and-fifty (350) random draws will be conducted at SHED Creative Agency, 110 Spadina Ave. Toronto Ontario, M5V 2K4 between October 3rd and 6th to determine the Tertiary Prize winners. Eligible Tertiary Prize winners will be notified by either telephone or email at such telephone number/email address as provided on the Contest entry form.

Before being declared a prize winner, all selected entrants must: (i)  correctly answer a time-limited mathematical skill-testing question without assistance or the use of a calculator, administered by email at the time of contact; and (ii) the selected entrant and his/her guests must sign a Declaration of Compliance with the Contest Rules and a Release of Liability, releasing the Contest Organizer and OLG and each of their respective subsidiaries, affiliates, directors, officers, governors, agents (collectively, the “Released Parties”) from any and all liability in connection with: (i) their participation in the Contest; (ii) the acceptance and use of any prizes awarded in connection with the Contest; and (iii) the administration of the Contest by the Contest Organizer, including (without limitation) the selection of prize winners or the distribution of prizes awarded in this Contest. The Declaration and Release documents must be returned on or before the date indicated on the documents or the applicable prize will be forfeited

If a selected entrant cannot answer, or incorrectly answers, the skill-testing question, or fails to respond to the notification within forty-eight (48) hours of the first attempted contact, or if UMC is otherwise unable to contact the selected entrant within such time, or if the selected entrant fails to return the executed Declaration and Release document within the time specified by the Contest Organizer, or if a selected entrant otherwise does not meet any of the Contest eligibility requirements, or does not accept his/her prize, or satisfy any other Contest conditions, that entry will be disqualified and another entry may be selected via random draw from all remaining eligible entries.

By entering the Contest, entrants agree to hold harmless and indemnify the Released Parties against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) their participation in the Contest; (ii) the receipt, use of or participation in the prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the prizes awarded herein. Furthermore, entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the entrant or any of the entrant’s representatives, heirs, next of kin or assignees (“Entrant’s Representatives”) may have or which may hereinafter accrue to the entrant or Entrant’s Representatives against the Released Parties as a result of the entrant’s participation in the Contest or the receipt or use of a prize awarded herein.

  1.      General Rules Each prize must be accepted as awarded and no prize substitutions of cash or otherwise or transfer of the prize will be made, provided that the Contest Organizer and OLG may make prize substitutions of equal or greater value, at their sole discretion. No telephone contact or correspondence will be entered into except with potential prize winners. Unclaimed prizes will not be awarded.

All participants must present valid government-issued photo identification upon request.

Concert Organizer and OLG may make any changes to the Grand Prize, Secondary Prize or Tertiary Prize including but not limited to concert day, time, or location up to an include the day of the performance due to any unforeseen circumstances.

By entering this Contest, each entrant consents to the use of his/her name, image, photograph, video, voice statement(s) and city of residence by the Contest Organizer and OLG without further compensation, for any and all publicity purposes, commercial or otherwise, in all media. The Contest is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

By entering the Contest, each entrant agrees to be bound by these Contest Rules and all decisions of the Contest Organizer and OLG, whose  decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of prize winners.  All decisions made by the Contest judges with respect to any aspect of this Contest are final.

The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases chances of winning; (2) non-compliance with these Contest Rules; and (3) any other act which the Contest Organizer and OLG determine, at their sole discretion, jeopardizes the integrity of the Contest.

The Contest Organizer and OLG may terminate, modify, suspend, or withdraw from this Contest (and/or any aspect thereof, including methods for selection of the prize winners), in whole or in part, at any time without notice for any reason, without liability, at their sole discretion, including, without limitation the delay or cancellation of the Broken Social Scene – the Phoenix Concert Theatre, October 14th, 2017 event in question or, if viruses, bugs, tampering, or other causes beyond the Contest Organizer’s and OLG’s control affect the security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or other means.  Further, the Contest Organizer and OLG reserve the right to disqualify any person and void any entries of that person who it believes has tampered with the entry process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest or who fails to meet or abide by these Contest Rules.

The Contest Organizer and OLG shall not be responsible for tampering, theft, human errors (including gross negligence) ineligibility, lost, late or misdirected entries or for any problems, failures or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet, or at any website and assume no liability for damage to entrant’s or any person’s computer resulting from participating in the Contest. Online entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.
